What is a Marriage Contract (ANC)?

An Antenuptial Contract (ANC) is a legal agreement signed before marriage that determines how assets and liabilities are divided between spouses. The contract specifies whether the couple is married out of community of property, with or without the accrual system. In South Africa, all ANCs must be registered at a Deeds Registry within three months of signing to be legally valid.

Which Deeds Registry Holds Your Contract?

Your ANC is stored at the Deeds Registry where it was originally signed and registered – not where you currently live. This is usually the Deeds Registry closest to where your attorney's practice was located at the time of signing. For example:

  • Signed in George, Knysna, or Mossel Bay → Western Cape Deeds Registry (Cape Town)
  • Signed in Sandton, Randburg, or Roodepoort → South Gauteng Deeds Registry (Johannesburg)
  • Signed in Pretoria, Centurion, or Midrand → North Gauteng Deeds Registry (Pretoria)
  • Signed in Durban or Pietermaritzburg → KwaZulu-Natal Deeds Registry (Pietermaritzburg)
